When deciding to officially change your name, you might come across terms like “Deed Poll” and “Change of Name Deed.” It’s important to understand that these terms are essentially interchangeable and serve the same legal purpose in the UK.
What Are They?
A Deed Poll or a Change of Name Deed is a legal document that formally declares your intention to permanently abandon your former name and adopt a new one. This declaration requires you to use your new name exclusively and also obligates others, including official bodies and institutions, to address you by your new name.
Is There Any Difference?
Although both terms are frequently used interchangeably, “Deed Poll” is generally the more common and widely recognised term in the UK. “Change of Name Deed,” on the other hand, is a slightly more formal and descriptive alternative but legally carries the same weight.
Enrolled vs Unenrolled Deed Poll
You may also encounter the terms “enrolled” and “unenrolled” when looking into deed polls:
- Unenrolled Deed Poll: This is the most common method used for changing names. An unenrolled deed poll is usually sufficient for updating your details with the DVLA, Passport Office, banks, and other official institutions.
- Enrolled Deed Poll: An enrolled deed poll is registered with the Royal Courts of Justice and published in The Gazette, providing additional public record and official recognition. However, enrolment is not mandatory, and it typically doesn’t provide significant additional benefits beyond the unenrolled option for everyday purposes.
Which Option Should You Choose?
For most individuals, an unenrolled deed poll (or Change of Name Deed) is more than sufficient for updating official documents and proving your new identity. However, if you prefer additional official recognition and public documentation of your name change, an enrolled deed poll might appeal to you.
The same principles apply for the Change of a Child’s name, although there would be an additional requirement to ensure that the name change was effected with the consent of all those holding ‘Parental Responsibility’ for the Child or with the authority of a Court Order.
