Remortgaging involves replacing the mortgage secured against your property with a new mortgage, usually without selling or moving home. You may be considering a remortgage because your existing deal is coming to an end, you have found a more suitable mortgage product, you want to release equity or you need to change your borrowing arrangements.

DTM Legal advises homeowners, joint property owners, landlords and other residential property owners on remortgages involving both freehold and leasehold properties. We can also assist where the remortgage is connected with a change in ownership, such as adding or removing someone from the property title.

Our Residential Conveyancing team will manage the legal process, communicate with your existing and new lenders and explain what is required at each stage. We will review the title to your property, deal with the repayment of your existing mortgage and register the new mortgage with HM Land Registry.

Remortgage Legal Services

We provide practical legal support throughout the remortgage process, including:

  • Confirming your identity and completing the required due diligence checks
  • Obtaining and reviewing the registered title to your property
  • Identifying and addressing any title issues that could affect the new mortgage
  • Obtaining a redemption statement from your existing lender
  • Reviewing your new mortgage offer and the lender’s legal requirements
  • Arranging any searches or search indemnity insurance required by the lender
  • Preparing and advising you on the mortgage deed
  • Agreeing and coordinating the completion date
  • Repaying your existing mortgage on completion
  • Sending any remaining mortgage funds to you
  • Registering the new mortgage with HM Land Registry
  • Assisting with a related transfer of equity or declaration of trust where required

Remortgage Costs

We provide a fixed fee for a standard residential remortgage rather than charging by the hour.

Standard Legal Fee

£675 plus VAT at 20%

Total including VAT: £810

This standard fee includes:

  • Obtaining and investigating the title to your property
  • Repaying your existing mortgage
  • Completing and registering your new mortgage

Third-Party Costs

You may also need to pay expenses charged by third parties. These are commonly known as disbursements and may include:

  • Office copies from HM Land Registry – approximately £7 plus VAT
  • Pre-completion searches – approximately £7 plus VAT
  • HM Land Registry application fees
  • Search indemnity insurance, where accepted by your lender – the cost will depend on the value of the mortgage

We will explain which third-party costs apply to your remortgage and include them within your individual quotation wherever possible.

Additional Legal Work

Some remortgages involve work beyond the standard legal process. The following fixed fees may apply:

  • Transfer of equity: £850 plus VAT at 20%
    Total including VAT: £1020
  • Declaration of trust: £250 plus VAT at 20%
    Total including VAT: £300

A transfer of equity may be required when someone is being added to or removed from the property title. A declaration of trust may be appropriate where joint owners want to record their respective financial interests in the property.

More complicated title issues, additional secured loans or requirements imposed by your lender may result in further legal work. We will notify you of any additional cost before carrying out that work.

You can instruct a solicitor once you have decided to proceed with a new mortgage application. Instructing your solicitor early can be particularly helpful where your existing deal is approaching its expiry date, as the title checks and identification requirements can begin while you wait for the formal mortgage offer.

You should tell your solicitor about any important dates, including the end of a fixed-rate period, the expiry of an early repayment charge or the deadline contained in your new mortgage offer.

The timescale depends on how quickly the mortgage offer is issued, the requirements of the new lender and whether any issues arise with the property title. Leasehold properties and remortgages involving ownership changes can take longer because information or consent may be required from additional parties.

Once we have received your completed instruction documents and identification, we will begin reviewing the title. We will keep you updated and explain if anything is likely to affect your intended completion date.

The searches required will depend on the instructions issued by your new lender. Some lenders require full property searches, while others may accept search indemnity insurance instead.

We will review the lender’s requirements and explain which option applies. Where insurance is accepted, its cost will usually depend on the value of the mortgage.
